Acceptable Use Policy

OrderToAI is built for one thing: helping a business re-engage the customers it already has — lawfully and respectfully. This policy sets the rules. It is part of, and incorporated into, the Terms of Service.
1. Permitted use
You may use the Service only to contact your own existing customers — people with whom you have a current Established Business Relationship (EBR), such as customers who transacted with you within the applicable look-back window — for legitimate purposes like win-backs, appointment and service reminders, restock alerts, loyalty rewards, and similar relationship communications.
2. Prohibited uses
You must not, and must not allow anyone to, use the Service to:
- contact people who are not your existing customers, or with whom you have no established business relationship (no cold outreach);
- upload or contact purchased, rented, scraped, harvested, or otherwise third-party-sourced lists, or data you are not authorized to use;
- send spam or bulk unsolicited calls or messages, or any communication prohibited by the TCPA, the Telemarketing Sales Rule, CAN-SPAM, or state law;
- contact any number on the federal, state, or your internal do-not-call lists, or anyone who has opted out or asked not to be contacted;
- call or text outside permitted hours, exceed reasonable frequency limits, or attempt to circumvent, disable, or defeat the Service’s compliance and abuse-prevention controls;
- harass, threaten, defraud, deceive, or mislead anyone; impersonate any person or business; or misrepresent the purpose of a communication;
- transmit content that is unlawful, defamatory, obscene, discriminatory, or that promotes illegal activity, or that violates anyone’s privacy or intellectual-property rights;
- collect payment-card or other sensitive financial information over the phone through the Service (the Service never handles payments);
- upload malware, attempt to breach security, probe or scan the Service, or reverse engineer, scrape, or resell any part of it; or
- use the Service in violation of any applicable law or these policies.
3. Your obligations
- maintain a genuine, current relationship with everyone you contact;
- obtain any consents and provide any disclosures the law requires for your calls, texts, and recordings;
- promptly honor opt-out and do-not-contact requests across all channels;
- identify your business accurately on every communication; and
- comply with all applicable telemarketing, messaging, recording-consent, and privacy laws.
4. You are responsible
You bear full and sole responsibility for the data you upload, the communications you initiate, and your compliance with the law. OrderToAI provides tools to help, but you are the party contacting your customers. You agree to indemnify OrderToAI LLC for claims arising from your use of the Service, as described in the Terms of Service.
When you create an account you affirmatively attest that:
- I will only contact my own existing customers — people with whom I have an established business relationship — and never purchased, rented, scraped, or cold-contact lists.
- I have obtained, or will obtain, every consent the law requires before they are contacted, including any prior express written consent needed for AI-voice or recorded/automated calls and for marketing texts.
- I am solely responsible for my compliance with the TCPA and all applicable federal and state telemarketing, calling-time, do-not-call, recording-consent, and privacy laws.
- I will promptly honor every opt-out / do-not-call / STOP request and keep my customer data lawful, accurate, and up to date.
- I will indemnify OrderToAI for any claim arising from my breach of these commitments, and OrderToAI may audit or suspend my account for suspected violations.
These attestations are recorded with your account. They are conditions of use — a breach may result in suspension or termination, and does not shift OrderToAI LLC's own regulatory obligations.
5. Monitoring and enforcement
We may monitor use for safety and compliance and may investigate suspected violations. We may, at our discretion and without liability, remove content, throttle or block messages, suspend or terminate accounts, and report unlawful activity to the authorities. We may act immediately where we believe there is legal or security risk or ongoing abuse.
