Compliance basics for AI calling

All plans

Automated calling in the United States is governed by the Telephone Consumer Protection Act. The distinction that matters is who you are calling. Contacting people you already do business with, an established business relationship, is a different legal position from cold calling strangers, and OrderToAI is built for the first case only. That is why signup asks you to confirm your list is your own customers, and why the product will not work from a purchased or scraped list. On top of that, three protections run automatically: opt-outs are honoured immediately across both calls and texts, calling hours follow each customer's own local time zone rather than yours, and outreach is limited to customers whose relationship with you is recent enough to qualify. This page is a plain explanation, not legal advice; rules change and your own counsel is the right source for your situation.

What the platform enforces automatically

  • Every outbound call opens by disclosing that it is an AI assistant.
  • Opt-out requests are honoured immediately and apply to both calls and texts.
  • Calling hours are enforced in the customer's own local time zone, not your business time zone.
  • Customers outside the contactable window are skipped rather than called.
  • Every call is re-checked at the moment of dialling, not only when the campaign was built.
  • Any caller can ask for a human and is transferred rather than argued with.

What remains your responsibility

  • Only uploading customers you genuinely do business with. The platform cannot see where a list came from.
  • Keeping your own records of the relationship, which the platform helps with by logging why each call was permitted.
  • Following any additional rules that apply to your state or your industry.

Why this is not robocalling

A robocall broadcasts a recording to numbers the caller has no relationship with. Every OrderToAI call is a live two way conversation with one of your own past customers, it adapts to what they say, it identifies itself as an AI, and it lets the person opt out or reach a human at any moment. Those are different activities in practice and in law.

Questions

Is it legal to have AI call my customers?
Calling your own existing customers stands on a different footing from cold calling strangers, and that established business relationship is the basis OrderToAI is built on. The product enforces disclosure, opt-outs, calling hours, and a contactable window on top of that. This is an explanation rather than legal advice, and your own counsel should confirm what applies to you.
What counts as an existing customer?
Someone who has chosen to do business with you, such as a past purchase, appointment, or service visit. It does not include people whose numbers you bought, scraped, or collected without a transaction. The contactable window also means the relationship needs to be recent enough to still count.
What happens if someone asks to stop being called?
They are suppressed immediately, across both calls and texts, for every future campaign. This is enforced by the platform rather than being left to you to remember, and it applies no matter which channel the request came through.
Can I upload a list I bought?
No. That breaks the attestation you accepted at signup and the legal basis the product runs on, and it is grounds for suspension. OrderToAI is deliberately built for re-engaging your own customers rather than for cold outreach.
